April 2, 2012 is the official start of the 2013 H-1B season, as it is the first day a company may file a petition to obtain H-1B status for the benefit of a foreign national employee or prospective employee. An H-1B visa is available to allow a foreign national to work for a U.S. company in a position which requires at least a bachelor’s degree in a particular field, if the foreign national possesses that particular degree. An H-1B visa is one of the most popular types of employment-based visas; however, there is a cap on the number of H-1B visas available each year. Accordingly, if a foreign national or U.S. company is interested in pursuing the H-1B process for the 2013 fiscal year (which begins on October 1, 2012), that process should begin as soon as possible, so that it may be completed in a timely manner.
