As Attorneys, we at Paule, Camazine & Blumenthal, P.C., are bound by professional standards governing confidentiality of client information. These standards include guidelines for communication over the internet by electronic mail ("e-mail").
Because of the recent development of e-mail communication, the governing body for Missouri attorneys requires that all attorneys explain to their clients the relative risks of communication by e-mail and obtain client consent to communication by e-mail.
COMMUNICATION BY E-MAIL IS NOT NECESSARILY SECURE AND CONFIDENTIAL. The Internet is inherently unstable. There is no authority or structure in the Internet that can guarantee or insure delivery of an e-mail, and there is no assurance that an e-mail message, if transmitted, will be delivered in a timely manner or to the appropriate person.
There are various ways in which communication by e-mail may be intercepted or accessed by someone who is not an intended sender or receiver of the e-mail. This could cause you to lose your confidentiality and attorney/client privilege protections. An unintended recipient could be anyone, including an otherwise disinterested person who could disclose the contents of the e-mail, or someone specifically interested in the matter which is the subject of the communication.
The risks of interception or unintended access by unintended persons include the following:
Random or intended interception as e-mail is actually traveling on the internet or on any network to which your computer may be connected.
Access to e-mail by using your internet account, password or other private access code to log in to your computer or internet account.
Access to e-mail displayed on your computer screen.
Access to e-mail stored on your home or office computer.
Access to e-mail stored on the "server" to your internet account or network to which your computer is connected.
Access to e-mail stored in "temporary" files, which essentially form a temporary backup system on your computer.
Access to office e-mail by your office system administrator.
Access to e-mail due to failure of our computer security system.
Inadvertently sending e-mail to the wrong e-mail address.
Inadvertently replying to e-mail by sending e-mail to an unintended recipient.
